These Terms of Use (the "Terms") form an agreement between you and VN CONSULTING COMPANY DOO ("we", "us", "our") governing your use of our mobile application (the "App"). By downloading, installing or using the App you agree to these Terms. If you do not agree to them, do not use the App.
You must be at least 13 years old, or older if the law of your country sets a higher minimum age for using a service of this kind, to use the App. If you are a minor under the law that applies to you, you may use the App only with the consent and supervision of a parent or legal guardian.
The App is an informational wellness tool. It measures your pulse using the device camera and flash, lets you record blood pressure, blood oxygen, stress and energy values manually, tracks medications and reminders you create, and presents trends, statistics, summaries and PDF reports based on the data you have recorded. All of this data is stored on your device, and all analysis is performed on your device.
The App is not a medical device. It does not diagnose, treat, cure or prevent any disease or condition, its readings are not of clinical accuracy, and nothing it shows you is medical advice. Never use it as a basis for a medical decision, and never delay seeking professional advice because of something the App has shown you. If you believe you are having a medical emergency, contact your local emergency services immediately.
We may update these Terms from time to time. The "Last updated" date above reflects the current version, and material changes will be made available through this page before they take effect. Continuing to use the App after an update means you accept the revised Terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App on Apple-branded devices that you own or control, for your own personal, non-commercial purposes.
You may not: copy, reproduce or distribute the App; sell, rent, lease, lend or sublicense it; modify, adapt, translate or create derivative works from it; reverse engineer, decompile or disassemble it, or otherwise attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction; remove or alter any proprietary notice; use it for any commercial purpose; or scrape, harvest or extract its data or content by automated means.
The App, its source code, design, interface, graphics, text, algorithms and all other content contained in it are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. These Terms grant you a license to use the App, not any ownership of it, and all rights not expressly granted are reserved.
The data you enter — measurements, medication names, reminder titles, questionnaire answers and profile details — remains yours. It is stored on your device, and we do not receive it. You are responsible for its accuracy and for keeping your own copies of anything you want to preserve; uninstalling the App or deleting the data within it removes it permanently, and we cannot restore it.
You agree not to use the App: in violation of any applicable law or regulation; to infringe the rights of others; to interfere with, disrupt, overload or attempt to gain unauthorised access to the App or to any system or network connected to it; to circumvent any security, authentication or purchase-verification mechanism; or in any way that could damage, disable or impair the App or the experience of other users.
The App offers an auto-renewing subscription that unlocks its premium features. Where an introductory or free trial period is offered, its length and conditions are shown on the purchase screen inside the App before you confirm.
All payments are processed by Apple through the App Store. We do not receive or handle your payment card or bank details. Refunds are administered by Apple in accordance with its policies; we can assist with a refund request but cannot grant one ourselves.
The App uses third-party services for analytics, crash reporting, marketing attribution and purchase processing, as described in our Privacy Policy. Those services operate under their own terms and privacy policies, and we are not responsible for their acts or omissions beyond the contractual protections we have put in place with them. The App does not use any third-party artificial intelligence service and does not send your data to one.
We aim to keep the App available and functioning but do not guarantee uninterrupted or error-free operation. Access may be suspended for maintenance, updates, or reasons outside our control. Measurement results depend on your device's camera and flash, on ambient light, on how steadily you hold your finger, and on other physical conditions, and may therefore vary in accuracy. We may change, suspend or discontinue any feature of the App at any time.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will meet your requirements, that its results will be accurate or reliable, or that defects will be corrected. Nothing in these Terms excludes a warranty or right that cannot be excluded under the law that applies to you as a consumer.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or in connection with your use of or inability to use the App. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid for the App in the twelve months preceding the event giving rise to the claim. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties. You agree to comply with all applicable local, national and international laws and regulations, including export control laws, when using the App.
The following provisions apply to your use of the App on an Apple device, and prevail over any conflicting provision of these Terms.
These Terms remain in effect until terminated. You may terminate them at any time by ceasing to use the App and uninstalling it. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. Termination does not entitle you to a refund of amounts already paid, except where a refund is required by applicable law or granted by Apple. Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability and governing law — continue to apply.
These Terms are governed by applicable law, and by any mandatory consumer-protection rules of the country in which you reside, which are not affected by this section. We encourage you to contact us first at help@vnconsultingcompany.info so that we can try to resolve any dispute informally.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
